The company reserves the right to amend or revise the T&C at any time by uploading a revised or amended T&C on the website with or without prior notice. The amended T&C will be effective immediately after it is uploaded on this website. Your access or use of the website following any such changes constitutes your acceptance to follow and you shall be bound by these T&C, as amended. The version of the T&C that will apply to your order will be those uploaded on the website at the time you use or access or place your order. This T&C does not alter in any way the terms or conditions of any other written agreement you may have with the company for other products or services.

All products are subject only to any applicable warranties of their respective manufacturers, distributors, and suppliers, if any, provided in the product packaging. To the fullest extent permissible by applicable law, we hereby disclaim all warranties of any kind, either express or implied, including without limitation, any implied warranties of merchantability, non-infringement, or fitness for a particular purpose. Homsara will take responsibility for your order, if the order has been shipped to any of the major cities (metros), where we use “Private Courier Companies” (eg. Delhivery, Ekart, Blue Dart etc.) to ship your order directly.

The prices and availability of products are subject to change without prior notice at the sole discretion of Homsara.

Sol reserves the right to refuse or cancel any order placed for a product that is listed at an incorrect price or for any other reason. This shall be regardless of whether the order has been confirmed and/or payment has been received. The payment shall be refunded, and the user shall be informed of the same.

If a non-delivery or late delivery occurs due to a mistake by the user (i.e., wrong or incomplete name or address or recipient not available) any extra cost spent by Homsara for re-delivery shall be claimed from the user placing the order.

The user agrees to give accurate, authentic and true information. Homsara reserves the right to confirm and validate the information and other details provided by the user at any point of time. If any such user details are found not to be true wholly or partly, Homsara has the right in its sole discretion to reject the registration and debar the user from using the services of Homsara (homsara.com) without prior intimation whatsoever.

Homsara will not be liable for any type or kind of credit card fraud. The liability to use a card fraudulently will be on the user and the onus to ‘prove otherwise’ shall be exclusively on the user. The user must exclusively use his/her own card on the site.

Homsara shall not entertain any complaints after 15 days of order delivery.

This agreement shall be construed in accordance with the applicable laws of India. The Courts of New Delhi shall have exclusive jurisdiction in any proceedings arising out of this agreement.

Force Majeure: The Company will not be deemed in default hereunder or held responsible for any cessation, interruption or delay in the performance of its obligations hereunder due to earthquake, storm, natural disaster, act of God, war, terrorism, armed conflict, labour strike, lockout, or boycott, any acts of nature labour disputes, floods, lightning, severe weather, shortages of materials, rationing, pandemic or epidemic, inducement of any virus, trojan or other disruptive mechanisms, any event of hacking or illegal usage of the website, utility or communication failures, revolution, civil commotion, acts of public enemies, blockade, embargo or any law, order, proclamation, regulation, ordinance, demand or requirement having legal effect of any government or any judicial authority or representative of any such government, or any other act whatsoever, whether similar or dissimilar to those referred to in this clause beyond our reasonable control. Further, if Force Majeure event takes place that affects the performance of our obligations under these T&C our obligations under these T&C shall be suspended for the duration of Force Majeure event. 

 

Entire Agreement: This T&C comprises the entire agreement between you and the company and supersedes any prior agreements pertaining to the subject matter contained herein
